While the perception of commercial legal expenses insurance has changed, take up remains low as businesses seem to be unaware of its benefits. Ana Paula Nacif explains that if policy penetration is to rise, the market will have to shout a little louder

Penetration priorities

Although there is no one-size-fits-all, most small firms still buy LEI as an add-on to their commercial insurance package. According to Frank O'Malley, director of Arc Legal Assistance, although the stand-alone market is getting bigger, it remains relatively small by comparison. "The highest penetration area is add-on policies, which are suitable for smaller companies but may not be appropriate for larger ones," he adds.

Specific cover has also been sought by companies offering specialist services to their clients. For example, Mr O'Malley explains that employment services companies may look to obtain a stand-alone LEI policy for their clients that only provides employment cover.

"Another area where this happens is tax protection," he adds. "You see accountancy firms providing their customers with specific LEI to indemnify them in case they are investigated by Inland Revenue."
