UNDERSTANDING THE WHIPLASH INJURY (AMENDMENT) REGULATIONS 2025: KEY CHANGES AND IMPLICATIONS

June 2025 - New regulations introduced an increase in the tariff for whiplash injuries—the values rising by up to 15% for injuries sustained on or after May 31, 2025. 
The Whiplash Injury (Amendment) Regulations 2025 have now come into force, marking the first amendment to the legislation introduced in the Civil Liability Act 2018, impacting individuals that pursue a claim for non-fault injury sustained in a Road Traffic Accident. These new regulations introduced an increase in the tariff for whiplash injuries—the values rising by up to 15% for injuries sustained on or after May 31, 2025.

This adjustment comes after a long period in which the cost environment has changed significantly, with the tariffs having not been altered since the introduction of the Civil Liability Act in 2021. While introducing the new tariffs is undoubtedly a welcome development for those seeking compensation for whiplash injuries, there are questions about whether the increases go far enough, particularly as the cost of living and inflation have significantly impacted many aspects of daily life.

What has remained consistent is the complexity of making and managing a Personal Injury claim.
